Drowsy Drivers Can Get DUI in Two Southern States

In Georgia and South Carolina, drivers can now get a DUI for drowsy driving. Because there is no test to to determine the sleepiness of a driver, it is up to the discretion of the officer whether to cite a DUI. A field test will determine if driver drowsiness is a factor in diminished driving ability.

The NSF's Sleep in America poll found when "driving drowsy, 42 percent of those polled said they become stressed, 32 percent get impatient and 12 percent tend to drive faster."

  • Commercial drivers-especially long-haul drivers – at least 15% of all heavy truck crashes involve fatigue
  • People with undiagnosed or untreated disorders-people with untreated obstructive sleep apnea have been shown to have up to a seven times increased risk of falling asleep at the wheel
  • Business travelers-who spend many hours driving or may be jet lagged
